Terms of Service
1. Who we are
PulseGuard is an uptime monitoring service operated by PulseGuard Limited, a company incorporated in Hong Kong (Business Registration No. 81113731) with its registered office at No. 5, 17/F, Strand 50, 50 Bonham Strand, Sheung Wan, Hong Kong ("PulseGuard", "we", "us"). These Terms govern your access to and use of the PulseGuard websites, applications and services (together, the "Service").
By creating an account, requesting access or using the Service, you agree to these Terms on your own behalf or on behalf of the company you represent.
2. The Service
PulseGuard provides monitoring of websites, APIs and servers, incident alerting, log collection and public status pages. PulseGuard onboards new workspaces in stages: features, limits and availability may change as the product develops, and access requests may be approved gradually.
The Service is intended for business use by customers acting in the course of their trade or profession. It is not directed at consumers.
3. Accounts and access
You must provide accurate information when requesting access and keep your credentials secure. You are responsible for all activity under your account. While onboarding is staged, we may decline, suspend or defer access at our discretion.
4. Acceptable use
You may only monitor endpoints that you own or are authorised to monitor. You must not use the Service to probe, scan or test third party systems without permission, to distribute malware, to interfere with the Service or other customers, or to violate any applicable law. We may suspend accounts that breach this section.
5. Fees
Published prices are stated per workspace per month, exclusive of any applicable taxes. During staged onboarding, fees may be waived or discounted as communicated to you. Paid subscriptions renew monthly until cancelled and can be cancelled at any time, taking effect at the end of the current billing period. We may change prices with at least 30 days notice; existing subscribers keep their launch price for the period stated at sign-up.
6. Your data
You retain all rights to the monitoring configurations, logs and other content you submit to the Service. You grant us the licence required to operate the Service, including storing and processing this content on infrastructure operated by our hosting providers. Our handling of personal data is described in the Privacy Policy.
7. Intellectual property
The Service, including its software, design and branding, is owned by PulseGuard Limited or its licensors. These Terms do not grant you any rights in the Service other than the right to use it in accordance with these Terms.
8. Availability and disclaimers
We work to keep the Service reliable, but it is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. Monitoring and alerting depend on networks and third party infrastructure outside our control; the Service is a detection tool and does not guarantee that incidents on your systems will be detected, reported or prevented.
9. Limitation of liability
To the maximum extent permitted by law, PulseGuard Limited shall not be liable for indirect, incidental, special or consequential damages, loss of profits, revenue or data. Our aggregate liability arising out of or in connection with the Service is limited to the fees you paid for the Service in the twelve months preceding the event giving rise to the claim, or USD 100 if no fees were paid. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms with notice where practicable. Sections that by their nature should survive termination will survive, including sections 6 to 9.
11. Changes to these Terms
We may update these Terms as the Service evolves. For material changes we will give notice by email or in the Service at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have exclusive jurisdiction, without prejudice to mandatory provisions of law applicable in your place of establishment.
